Terms and Conditions

Welcome to kindledwithin.com (the “Site”), operated by Kindled Within Coaching (“Kindled Within,” “we,” “us,” “our,” or the “Company”).

These Terms and Conditions (“Terms”) apply to your use of the Site and your purchase, access, or participation in services and resources offered by Kindled Within, including:

Individual coaching sessions;
Coaching packages and memberships;
Kindled Access benefits;
Group coaching programs;
Workshops and webinars;
Speaking engagements;
Private member areas and online communities;
Live and recorded sessions;
Digital materials and downloadable resources; and
Other coaching, educational, or personal-development services.

These offerings are collectively referred to as the “Services.”

By using the Site, booking a session, purchasing or accessing a Service, creating a member account, or participating in a Kindled Within program, you acknowledge that you have read and agree to these Terms, our Privacy Policy, our Coaching Disclaimer, and any additional terms presented for the applicable Service.

If you do not agree to these Terms, you may not use the Site or participate in the Services.

1. Eligibility

The Services are intended for individuals who are at least 18 years old.

By purchasing or participating in a Service, you represent that you are at least 18 years old and legally able to enter into this agreement.

2. Coaching Services

Kindled Within offers individual coaching sessions, coaching memberships, group coaching, workshops, programs, and other educational and personal-development experiences.

The description, price, schedule, included benefits, and availability of each Service will be stated on the applicable pricing, sales, registration, booking, or checkout page.

Booking a Free Mini Session does not create an obligation to purchase additional coaching or continue working with Kindled Within.

Prices and Service offerings may change. The terms and price presented when you purchase or enroll will apply to that purchase, except where a later change is required by law or separately agreed to by you.

Additional information about what coaching is and is not is provided in our Coaching Disclaimer, which is incorporated into these Terms by reference.

3. Individual Coaching Payments, Cancellations, and Rescheduling

Payment for an individual coaching session is due before the session begins. If payment is not received, the session may be canceled or withheld.

Individual coaching sessions require at least 24 hours’ notice to cancel or request rescheduling.

If you provide at least 24 hours’ notice, you may request to reschedule the session, subject to availability.

Sessions canceled with less than 24 hours’ notice, missed without notice, or joined 15 minutes or more after the scheduled start time are forfeited, counted as used, and are not eligible for a refund, credit, or rescheduling.

Once a session has begun or been completed, the payment is nonrefundable.

If Kindled Within must cancel a session, we will offer a reasonable opportunity to reschedule it or provide another appropriate remedy.

4. Coaching Memberships

Kindled Within may offer recurring coaching memberships that include a specified number or frequency of private coaching sessions.

Current membership options, pricing, and benefits are may be stated on the applicable pricing and checkout pages.

Two-Session Coaching Membership

A two-session coaching membership includes two 50-minute individual coaching sessions during each monthly billing period, unless otherwise stated at enrollment.

No more than one session may ordinarily be used during a calendar week.

Unused sessions may roll into the next billing period, up to a maximum of four available sessions during a single month. Sessions remain subject to the limit of no more than one session per week.

Rolled-over sessions are available only while the membership remains active and payments remain current. When the membership ends or payment lapses, unused and rolled-over sessions are forfeited.

Weekly Coaching Membership

A weekly coaching membership includes one 50-minute individual coaching session each week, unless otherwise stated at enrollment.

When a member cannot attend a scheduled session, the member may request to move it to another available time during the same calendar week.

Rescheduling within the same week is subject to availability and is not guaranteed. Weekly sessions do not roll into a future calendar week unless Kindled Within expressly agrees otherwise.

Planned Time Off

Kindled Within may take planned breaks or scheduled time off during the year. We will communicate known interruptions to affected clients in advance when reasonably possible.

Recurring membership pricing accounts for occasional planned breaks. Those weeks are not ordinarily discounted, credited, or made up unless otherwise stated in writing.

5. Automatic Renewal and Membership Cancellation

Recurring coaching memberships automatically renew each month using the payment method provided at checkout until canceled.

By enrolling in a recurring membership, you authorize Kindled Within and its payment processor to charge the applicable membership fee at the beginning of each billing period.

You may cancel a recurring membership through any cancellation method made available in your member account or by contacting us at hello@kindledwithin.com

Cancellation prevents future renewal but does not immediately end access.

After cancellation:

You will retain applicable coaching and member benefits through the end of your current paid billing period;
You will not be charged for the following billing period; and
Membership access will end when the current paid billing period expires.

Amounts already charged for the current billing period are not prorated or refunded solely because you cancel before that billing period ends, except where required by law or expressly stated otherwise.

6. Kindled Access

Certain coaching memberships may include Kindled Access as an additional benefit.

Kindled Access may include access to eligible:

Group coaching programs;
Workshops;
Live webinars;
Speaking engagements;
Event recordings;
Replays;
Member-only resources;
Journaling materials;
Challenges;
Downloads; and
Other selected Kindled Within content or experiences.

The specific benefits available through Kindled Access may change over time. Not every program, event, product, or Service is necessarily included.

A Service is included in Kindled Access only when Kindled Within identifies it as an eligible member benefit.

Active Membership Required

Kindled Access is available only while the applicable membership remains active and paid.

When the membership ends, access to included live sessions, member pages, recordings, downloads, program materials, and other Kindled Access benefits ends at the conclusion of the current paid billing period.

The member does not obtain permanent ownership or lifetime access to programs or content accessed through Kindled Access.

Joining an Existing Program

A member who joins after an included group program has already started may receive access from the date the membership begins and moving forward.

Access to earlier sessions, modules, recordings, challenges, or materials is not guaranteed unless Kindled Within expressly provides that access.

Returning Members

Rejoining a membership does not guarantee that previously accessed content will be restored.

A returning member receives access to eligible content and benefits available from the effective date of the new membership and moving forward.

Previously completed, expired, removed, or archived programs and materials may no longer be available.

Kindled Access and Program Guarantees

Access received through Kindled Access is a membership benefit and is not considered a standalone purchase of the included program.

A refund guarantee or satisfaction guarantee offered for a standalone program does not apply to a member who receives access through Kindled Access unless the applicable program-specific terms expressly state otherwise.

Kindled Access members remain subject to the cancellation and refund rules governing their coaching membership.

7. Group Programs, Workshops, and Webinars

Kindled Within may offer group coaching programs, workshops, courses, webinars, and other educational or personal-development experiences.

These Services may include:

Live online sessions;
Coaching discussions;
Educational presentations;
Guided exercises;
Self-compassion practices;
Journaling prompts;
Multi-week challenges;
Reflection exercises;
Private member pages;
Recordings and replays; and
Downloadable or digital materials.

Programs may vary in duration, format, price, subject matter, schedule, participation requirements, and access period.

The specific details of a program will be described on its applicable sales, registration, enrollment, or checkout page.

Kindled Within may make reasonable changes to lesson order, session topics, facilitators, delivery format, schedules, or materials when needed to improve the experience, respond to group needs, manage technical or scheduling issues, or address circumstances outside our reasonable control.

We will communicate significant changes to enrolled participants as soon as reasonably possible and, when appropriate, may reschedule a session, provide an alternative delivery method, or make replacement content available.

8. Program-Specific Terms

Certain programs, workshops, memberships, or other Services may be subject to additional terms, including:

Program dates and schedules;
Payment plans;
Cancellation policies;
Refund policies;
Participation expectations;
Conditional guarantees;
Attendance requirements;
Access periods;
Recording terms;
Included resources; and
Other enrollment conditions.

Those additional terms may be presented on the applicable:

Sales page;
Registration page;
Checkout page;
Order form;
Enrollment agreement;
Confirmation email; or
Program information page.

By enrolling in or purchasing that Service, you also agree to the applicable program-specific terms presented before or at the time of purchase.

If program-specific terms conflict with these general Terms, the program-specific terms will control only with respect to that particular Service.

A refund policy or guarantee applies only when it is expressly offered in writing for the applicable Service. A guarantee offered for one program does not automatically apply to another program or Service.

9. Group-Program Payments

The program fee and available payment options will be stated before enrollment.

Payment may be required:

In full at enrollment;
Through an installment plan; or
According to another payment schedule stated at checkout.

By enrolling, you authorize Kindled Within and its payment processor to charge the payment method you provide according to the payment option selected.

Payment Plans

By selecting a payment plan, you agree to pay all scheduled installments, including any difference between the payment-plan total and the pay-in-full price, unless you qualify for a cancellation or refund right expressly stated in the applicable program-specific terms.

Unless a participant qualifies for a refund or cancellation right expressly provided in the applicable program-specific terms:

Withdrawing from the program does not cancel remaining installments;
Missing live sessions does not cancel remaining installments;
Failing to access recordings or materials does not cancel remaining installments; and
Choosing not to participate does not cancel remaining installments.

If a scheduled payment fails, Kindled Within may:

Retry the payment;
Request an updated payment method;
Temporarily suspend access;
Provide a reasonable period to bring the account current; or
Terminate access after continued nonpayment.

If a program-specific refund is approved for a payment-plan participant, the applicable program terms will determine whether prior payments are refunded and whether future installments are canceled.

10. Refunds

Except where a different refund policy is expressly offered in writing for a particular Service, payments for coaching, memberships, programs, workshops, events, recordings, and digital materials are nonrefundable once paid, except where required by applicable law.

Failure to attend, participate, schedule sessions, access materials, watch replays, or complete a program does not by itself create a right to a refund.

Any approved refund will be returned to the original payment method unless another method is agreed to in writing.

Approved refunds may take up to 30 calendar days to be issued. Additional processing time imposed by a bank, card issuer, or payment provider may apply.

11. Promotional Offers and Referral Discounts

Kindled Within may occasionally offer promotional prices, referral benefits, discounts, credits, or other incentives.

The conditions, eligibility requirements, value, expiration, and limitations of a promotion will be stated when the promotion is offered.

Unless otherwise stated:

Promotions may not be combined;
Promotions have no cash value beyond the stated credit or refund;
A discount cannot exceed the amount actually paid;
Promotional benefits are not transferable;
A referred participant must be a new customer;
The referred participant’s payment must successfully clear; and
Kindled Within may delay a referring participant’s benefit until the referred participant’s applicable refund period has expired.

If a referred participant cancels, receives a refund, disputes the payment, or fails to complete payment, the referring participant may no longer qualify for the referral benefit.

12. Member Accounts

Participants may be required to create a private account to access Kindled Within programs, Zoom information, recordings, replays, materials, and member-only resources.

You agree to:

Provide accurate and current account information;
Maintain the confidentiality of your password;
Use your account only for your own participation;
Notify us promptly if you believe your account has been compromised; and
Avoid permitting anyone else to access Services through your account.

Member access is personal to the enrolled participant.

You may not share:

Login credentials;
Private Zoom links;
Replay links;
Member-page links;
Passwords;
Downloadable materials; or
Other protected content.

You are responsible for activity occurring through your account to the extent permitted by law.

Kindled Within may suspend or terminate access if we reasonably believe an account or protected material has been shared, misused, or accessed without authorization.

13. Program Access and Availability

Program materials and recordings are available only for the period stated on the applicable program, membership, or enrollment page.

Kindled Within does not promise lifetime or permanent access unless that promise is expressly made in writing.

Access may end upon:

Expiration of the stated access period;
Membership cancellation;
The end of a paid billing period;
An approved refund;
Continued nonpayment;
Termination for violation of these Terms; or
Closure or discontinuation of a program.

Kindled Within may reasonably revise, replace, reorganize, archive, or remove materials.

Participants are responsible for accessing or downloading any permitted materials during the applicable access period.

We do not guarantee that every live session will be recorded or that every recording will remain available for the same amount of time.

14. Recording of Live Sessions

Kindled Within programs, workshops, webinars, group coaching sessions, and other events may be recorded in video, audio, transcript, chat, or other electronic formats.

Recordings may be made available to current enrolled participants through a private member area.

By enrolling and participating in a Service identified as recorded, you understand that your:

Voice;
Image;
Display name;
Chat messages;
Questions;
Comments; and
Other contributions

may appear in a recording shared privately with other authorized participants.

Participation Choices

A participant who does not want her image recorded may keep her camera off.

However, her voice, display name, chat messages, or other contributions may still be recorded if she participates.

A participant who does not consent to being recorded should not participate in the recorded portion of the session and may contact Kindled Within regarding any available alternative. Alternatives are not guaranteed unless required by law or stated for the particular Service.

Editing and Availability

Kindled Within may pause, stop, edit, shorten, omit, or remove portions of a recording.

Sensitive individual coaching, private disclosures, technical interruptions, participant discussions, or other portions may be excluded.

We do not guarantee that:

Every part of a session will be recorded;
Every participant contribution will appear;
Every recording will be edited;
A replay will be provided for every session; or
A recording will remain available permanently.

Public Promotional Use

Kindled Within will not intentionally use an identifiable participant’s image, name, voice, story, testimonial, or personal contribution in public advertising or social-media marketing without separate permission, except where the content has been lawfully anonymized so that the participant is not reasonably identifiable.

Consent to private program recording is not the same as consent to public promotional use.

Participant Recording Prohibited

Participants may not independently:

Record;
Photograph;
Screenshot;
Transcribe;
Copy;
Download;
Republish; or
Distribute

live sessions or private replays unless Kindled Within gives express written permission.

15. Group Confidentiality

Group programs may involve participants sharing personal experiences, thoughts, goals, challenges, emotions, and other sensitive information.

By participating, you agree not to disclose, repeat, record, screenshot, publish, or share another participant’s:

Name;
Image;
Voice;
Story;
Comments;
Circumstances;
Contact information; or
Other personal information

outside the program without that participant’s express permission.

You may discuss your own experience and what you personally learned, but you may not identify another participant or disclose details that would reasonably allow someone to identify her or him.

Kindled Within will take reasonable steps to encourage a respectful and private environment. However, because group programs involve other participants and internet-based communication, we cannot guarantee that every participant will maintain confidentiality or that electronic information will never be accessed, copied, or disclosed without authorization.

By choosing to share in a group setting, you accept these inherent confidentiality risks.

Coaching is not a legally privileged relationship in the same manner as certain licensed professional relationships. Kindled Within may disclose information when required by law or otherwise permitted under applicable law.

16. Participant Conduct

Participants agree to treat Kindled Within, its representatives, and other participants respectfully.

The following behavior is prohibited:

Harassment;
Threats;
Bullying;
Intimidation;
Discrimination;
Sexual misconduct;
Deliberate humiliation;
Repeated disruption;
Unlawful activity;
Violations of another participant’s privacy;
Unauthorized recording;
Sharing protected program content;
Commercial solicitation without permission; or
Conduct that reasonably threatens the safety, privacy, or integrity of the program.

Participants may not use contact information obtained through a Service to advertise, solicit, recruit, or sell unrelated products or services without prior permission.

Kindled Within may provide a warning, mute a participant, remove a participant from a live session, restrict account access, or terminate participation when reasonably necessary.

Immediate action may be taken when conduct threatens safety, privacy, confidentiality, intellectual property, or the experience of other participants.

A participant removed for a material violation of these Terms is not entitled to a refund solely because access was terminated, except where required by law.

17. Coaching Is Not Therapy or Professional Treatment

Kindled Within provides coaching, education, reflection exercises, personal-development tools, and opportunities for discussion.

The Services do not provide:

Psychotherapy;
Mental-health counseling;
Diagnosis;
Medical treatment;
Crisis intervention;
Legal advice;
Financial advice; or
Other licensed professional services.

Participation does not create a therapist-client, physician-patient, attorney-client, financial-advisor, or other licensed professional relationship.

The Services are not intended to diagnose, prevent, cure, or treat a mental-health or medical condition.

You are responsible for determining whether participation is appropriate for you and for consulting qualified professionals regarding your individual needs.

Kindled Within does not provide emergency or crisis services.

If you are experiencing an emergency, believe you may harm yourself or someone else, or require urgent medical or mental-health assistance, do not rely on the Site, coaching program, member portal, email, or a scheduled coaching session for assistance. Contact appropriate emergency services or a qualified crisis-care provider.

18. Personal Responsibility

You remain responsible for your own decisions, actions, relationships, health, safety, finances, and well-being.

Participation in coaching does not transfer decision-making responsibility to Kindled Within.

You decide whether and how to apply information, questions, exercises, suggestions, challenges, and other program content.

You should use your own judgment and seek appropriate professional advice when a decision involves medical, psychological, legal, financial, safety, employment, or other specialized concerns.

19. No Guarantee of Results

Kindled Within does not guarantee that participation in coaching, memberships, programs, workshops, webinars, or other Services will produce any particular:

Personal result;
Emotional outcome;
Transformation;
Relationship outcome;
Financial result;
Business result;
Professional result; or
Other outcome.

Each participant’s experience is different. Progress and results may depend on individual circumstances, choices, participation, effort, readiness, available support, and factors outside the control of Kindled Within.

You remain responsible for deciding whether and how to apply the information, questions, exercises, reflections, challenges, and other content provided through the Services.

Testimonials, participant stories, examples, and illustrations describe individual experiences only. They do not represent or promise that another participant will achieve the same or similar results.

When a particular program offers a refund policy or participation guarantee, that policy applies only according to the program-specific terms presented for that purchase. A refund guarantee does not promise that a participant will achieve any particular personal, emotional, relational, professional, or other result.

20. Website and Service Disclaimer

The Site, member portal, digital materials, recordings, and other online features are provided on an “as available” basis.

Kindled Within makes reasonable efforts to provide accurate, useful, and current information. However, we do not guarantee that the Site, Services, or content will always be complete, accurate, current, uninterrupted, secure, compatible with every device, or free from errors.

The Site or Services may occasionally be unavailable because of maintenance, updates, technical problems, security concerns, internet or power outages, third-party platform failures, or events beyond our reasonable control.

Kindled Within is responsible for delivering purchased Services substantially as described, subject to these Terms, applicable program-specific terms, reasonable modifications, and circumstances outside our reasonable control.

To the fullest extent permitted by applicable law, Kindled Within disclaims warranties that are not expressly stated in these Terms or the applicable program-specific terms.

Nothing in this section limits any warranty, right, or remedy that cannot legally be excluded or limited.

21. Illustrations and Privacy

Kindled Within may use licensed stock photographs, models, illustrations, fictional examples, composite stories, altered names, or modified identifying details for educational, illustrative, or promotional purposes.

Unless expressly identified as an actual participant or testimonial, individuals shown or described in photographs, illustrations, examples, or stories should not be understood to be:

Current or former coaching clients;
Program participants;
Individuals who have experienced the circumstances described;
Individuals who achieved a stated result; or
Endorsers of Kindled Within or its Services.

The use of an image near content discussing personal growth, divorce, relationships, self-compassion, emotional experiences, people-pleasing, confidence, mental health, or other personal circumstances does not mean that the person shown has experienced those circumstances.

Kindled Within may use third-party photographs, artwork, and other materials under applicable licenses or permissions. Ownership of those materials remains with their respective creators or rights holders.

When Kindled Within publicly shares a real participant’s identifiable name, image, voice, story, or testimonial, we will obtain separate permission as appropriate.

Kindled Within may alter names or identifying details, combine experiences, or use fictionalized examples to protect privacy. Such examples are provided for educational or illustrative purposes and may not describe one specific individual.

22. Intellectual Property

All original Kindled Within content is owned by or licensed to Kindled Within and is protected by applicable intellectual-property laws.

Protected content includes, without limitation:

Website text;
Graphics;
Branding;
Videos;
Recordings;
Audio;
Transcripts;
Lessons;
Presentations;
Slides;
Journal prompts;
Challenges;
Worksheets;
Exercises;
Downloads;
Emails;
Member-area content;
Program structure; and
Other original materials.

Certain photographs, graphics, fonts, videos, or other materials may be owned by third parties and used under a license, permission, or other lawful right. Ownership of those materials remains with the applicable creator or rights holder.

Enrollment or purchase grants you a limited, revocable, nonexclusive, nontransferable license to access and use the applicable materials solely for your own personal, noncommercial use during the stated access period.

You may not, without prior written permission:

Copy or reproduce protected content;
Share it with another person;
Publish or upload it publicly;
Resell it;
Distribute it;
Teach from it commercially;
Modify it for commercial use;
Create a competing program from it;
Remove copyright, trademark, attribution, or ownership notices; or
Use it outside the permission expressly provided.

Purchasing or accessing a Service does not transfer ownership of Kindled Within’s intellectual property.

Participants may not upload confidential program recordings, participant contributions, or substantial portions of protected materials into public or third-party artificial-intelligence systems without written permission.

Nothing in these Terms restricts a participant from discussing her own personal experiences, insights, or independently developed ideas, provided she does not disclose another participant’s confidential information or copy, distribute, or commercially reproduce Kindled Within’s protected materials.

23. Speaking Engagements and In-Person Events

Kindled Within may provide speaking engagements, workshops, trainings, or other events for groups and organizations.

The scope, schedule, fee, location, expected attendance, travel arrangements, recording permissions, cancellation terms, and other details may be governed by a separate written event agreement.

Host Responsibilities

When an organization or individual hosts an in-person event, the host is responsible for providing:

A reasonably safe venue;
Appropriate facilities;
Agreed-upon equipment;
Reasonable crowd management;
Compliance with venue requirements; and
The safety and conduct of its attendees.

Kindled Within’s participation does not transfer responsibility for venue conditions, event operations, or attendee conduct to Kindled Within.

Attendee Assumption of Risk

Attendance at an in-person event is voluntary.

Attendees accept the ordinary risks associated with travel, attendance, venue conditions, interaction with others, and participation in activities.

Nothing in these Terms waives liability that cannot legally be waived.

Event Photos and Recordings

Photography, recording, or livestreaming arrangements for speaking engagements and in-person events will be addressed in the applicable event information or written agreement.

A host may not commercially use or distribute recordings featuring a Kindled Within speaker or proprietary materials without written permission.

24. Technology and Third-Party Platforms

Services may be delivered through third-party platforms, including providers of:

Website hosting;
Membership management;
Payment processing;
Video conferencing;
Cloud recording;
Email;
Scheduling; and
Digital content delivery.

These providers may include WordPress, Paid Memberships Pro, Stripe, Zoom, and other service providers selected by Kindled Within.

Participants are responsible for obtaining:

A compatible device;
A supported browser;
A reliable internet connection;
Functional audio;
Any necessary software; and
The ability to receive program emails.

Although we use reputable providers and take reasonable steps to maintain access, no electronic or internet-based system is completely secure, uninterrupted, or error-free.

We do not guarantee uninterrupted access to the Site, member portal, live sessions, recordings, payment systems, or email communications.

When a significant technical failure under our reasonable control prevents delivery, we may offer a rescheduled session, replacement recording, alternative delivery method, or another reasonable remedy.

Technical problems involving a participant’s own device, connection, browser, password, email account, or third-party settings do not automatically create a right to a refund.

25. Events Beyond Our Control

Kindled Within will not be responsible for a delay, interruption, modification, or failure to perform caused by an event beyond our reasonable control.

Such events may include:

Severe weather;
Natural disasters or other acts of God;
Fire;
Widespread power or internet outages;
Public-health emergencies;
Government actions or orders;
War;
Terrorism;
Civil unrest;
Labor disruptions;
Transportation interruptions; or
Significant failures of third-party platforms or service providers.

If such an event affects a Service, Kindled Within may reasonably reschedule, modify, postpone, relocate, substitute, or provide an alternative method of delivery.

We will communicate significant changes to affected participants as soon as reasonably possible.

If a Service cannot reasonably be provided, Kindled Within will determine an appropriate remedy consistent with the applicable program-specific terms and applicable law.

26. Electronic Communications

By creating an account, booking a Service, or enrolling in a program, you consent to receive communications reasonably related to your transaction or participation, including:

Receipts;
Account notices;
Session reminders;
Schedule changes;
Program instructions;
Access information;
Payment notices; and
Policy updates.

Transactional and program-related communications are separate from optional marketing messages.

You are responsible for providing an accurate email address and checking your inbox, spam folder, and account notices.

27. Privacy

Our collection and use of personal information is governed by our Privacy Policy.

Third-party platforms may also collect and process information under their own privacy policies and terms.

Please review the privacy policies of payment, membership, video-conferencing, and other third-party providers you use.

28. Third-Party Links and Services

The Site and Services may contain links to third-party websites, resources, platforms, or tools.

Kindled Within does not control and is not responsible for third-party content, availability, security, privacy practices, statements, products, or services.

A link or reference does not necessarily represent an endorsement.

Your use of a third-party service is governed by that provider’s terms and policies.

29. Limitation of Liability

To the fullest extent permitted by applicable law, Kindled Within will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to:

Use of the Site;
Participation in a Service;
Use or inability to use a member portal;
Reliance on coaching or educational content;
Participant conduct;
Unauthorized disclosure by another participant;
Technology failures; or
Third-party services.

To the fullest extent permitted by law, Kindled Within’s total liability arising from a particular paid Service will not exceed the amount you actually paid directly to Kindled Within for that Service.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

30. Indemnification

To the extent permitted by law, you agree to indemnify and hold Kindled Within harmless from third-party claims, liabilities, damages, or expenses arising from:

Your unlawful conduct;
Your material violation of these Terms;
Your infringement of another person’s rights;
Your unauthorized sharing of protected content; or
Your disclosure or misuse of another participant’s confidential information.

This provision does not require you to indemnify Kindled Within for claims caused solely by Kindled Within’s own unlawful conduct.

31. Suspension and Termination

Kindled Within may suspend or terminate access when a participant:

Fails to make a required payment;
Shares account credentials or protected links;
Violates participant confidentiality;
Engages in prohibited conduct;
Infringes intellectual-property rights;
Misuses the Site or member portal; or
Materially violates these Terms.

When appropriate, we may provide notice and a reasonable opportunity to correct the issue.

We may act immediately when reasonably necessary to protect safety, privacy, confidential information, intellectual property, the program, or other participants.

Termination does not automatically eliminate a valid payment obligation or create a right to a refund, except as required by law or stated in applicable program-specific terms.

32. Governing Law and Venue

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules.

Unless applicable law requires otherwise, any legal action arising from these Terms or the Services must be brought in a court with appropriate jurisdiction located in Utah County, Utah.

33. Changes to These Terms

Kindled Within may update these Terms from time to time.

The updated version will be posted on this page with a revised effective date.

Material terms applicable to a paid Service will generally be the terms accepted when that Service was purchased.

Later updates may apply when:

Required by law;
Needed to address security or technical operations;
Applied prospectively to a renewal or future purchase; or
Separately accepted by the participant.

34. Severability

If a court determines that any provision of these Terms is invalid or unenforceable, the remaining provisions will continue in effect.

The invalid or unenforceable provision will be interpreted or limited as closely as legally permitted to reflect its intended purpose.

35. No Waiver

A delay or failure by Kindled Within to enforce a provision does not waive the right to enforce it later.

An exception made for one participant or situation does not require the same exception in another situation.

36. Assignment

You may not transfer your membership, enrollment, account, or rights under these Terms to another person without written permission.

Kindled Within may assign these Terms in connection with a lawful business reorganization, sale, transfer, or change in legal entity.

37. Entire Agreement

These Terms, together with the applicable:

Privacy Policy;
Coaching Disclaimer;
Program-specific terms;
Sales-page disclosures;
Checkout disclosures;
Enrollment agreements; and
Written policies incorporated by reference

constitute the agreement between you and Kindled Within regarding the applicable Service.

If program-specific terms conflict with these general Terms, the program-specific terms will control only with respect to that particular Service.
